LEGAL REGULATION OF NORTH INDIGENOUS PEOPLE TRADITIONAL ECONOMY*

Abstract. Modern global transformational processes require society to rethink the logic of historical development, to abandon the exclusively linear perception of the movement of society in the spirit of modern evolutionism, in which the complication of the system in the direction of increasing the produced and consumed resources was assessed as extremely positive. One of the lines of this rethinking is the increased attention to traditional economies, which become for researchers not just an exotic object of ethnological study, but a model for the reorganization of the current economic model. Traditional economies can be learned from rational use of natural resources, they fit well into the mainstream of pre-colonial and post-colonial discourses, and contribute to the preservation of ethnic self-identification, which is important in the framework of criticism of globalization and its attention to localities. However, it is impossible to instantly restructure the system in the direction of traditional management, and at this stage it becomes important to create social systems that provide a bridge between traditional and modern. In this article, as such a bridge, the modern legal framework of Russia and the world, which regulates the traditional economy of the indigenous peoples of the North, is considered. But based on the analysis of the main legislative acts of the Russian Federation and the norms of international law, the following conclusions are made about the current state of the legal platform of the traditional economy. Firstly, the existing laws refer to the traditional economy from the standpoint of the modern colonial system, which means that it is necessary to form “traditional law” as a system that allows taking into account all the specifics of management, as a number of foreign researchers say. Secondly, the existing legislation establishes the concept of “traditionality” as purely formal and external in relation to the group of indigenous peoples, because of which there is an inconsistency between the legislative definition of traditional economic activity and its actual implementation in areas inhabited by indigenous peoples.
